These Terms of Use govern access to and use of the Custoo website, customization tools, and related online services.

1. Agreement

These Terms of Use ("Terms") are a contract between you and Custoo, operated by MOUSSED-WERNITZ DIMOS ("we," "us," or "our"), for your use of https://custoo.shop and related services (the "Service").

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Purchases are also governed by our Terms of Sale and Return Policy.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.

You represent that you have the legal capacity to enter into these Terms and that your use of the Service complies with applicable law in your location.

3. The Service

Custoo provides an online platform to browse templates, customize products with your content, generate or refine artwork with AI-assisted tools, preview mockups, and purchase made-to-order physical goods.

We may change, suspend, or discontinue features at any time. Preview images, AI outputs, and site content are provided for convenience and may not always reflect the final printed product.

4. Accounts and security

Some features may require an account. You agree to provide accurate information and keep your credentials confidential. You are responsible for activity under your account.

Notify us promptly at help@custoo.shop if you suspect unauthorized access. We may suspend or terminate accounts involved in abuse, fraud, or policy violations.

5. Your content

"Your Content" means photos, prompts, text, uploads, and other materials you submit through the Service, as well as designs created from them.

You retain ownership of Your Content, subject to the licenses below. You represent that you have all rights needed to submit and use Your Content on Custoo and that it does not infringe third-party rights or violate law.

You grant Custoo a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, display, and use Your Content solely to operate the Service, generate previews and production files, fulfill orders, provide support, prevent abuse, and improve quality controls.

6. AI-generated outputs

The Service may use third-party AI systems to generate or modify images based on your inputs. AI outputs can be unpredictable and may require review before purchase.

You are responsible for reviewing AI-assisted designs for accuracy, spelling, likeness rights, trademarks, and suitability before checkout. We do not guarantee that AI outputs are unique, error-free, or free of third-party claims.

Do not submit sensitive personal data, confidential information, or content you are not authorized to use. Additional data handling details are in our Privacy Policy.

7. Custoo intellectual property

The Service, including site design, branding, templates, software, text, graphics, and logos, is owned by Custoo or its licensors and protected by intellectual property laws.

Except for the limited rights needed to use the Service, no license is granted to copy, modify, distribute, reverse engineer, or create derivative works from Custoo materials without our prior written consent.

8. Prohibited conduct

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Upload or generate content that is illegal, defamatory, hateful, or exploitative
• Infringe copyrights, trademarks, publicity rights, or privacy rights of others
• Attempt to bypass security, scrape the Service at scale, or disrupt infrastructure
• Use bots or automated means except as we expressly allow
• Resell, sublicense, or commercially exploit the Service except through normal purchases
• Submit malware, spam, or content involving minors in sexual or exploitative contexts

We may remove content, block orders, or suspend access where we reasonably believe these Terms or law have been violated.

9. Third-party services

The Service integrates third-party providers such as Shopify (checkout), Gelato (production), AI vendors, analytics tools, and hosting providers. Your use of those services may be subject to their own terms and privacy notices.

We are not responsible for third-party websites, services, or content linked from the Service.

10. Feedback

If you send suggestions, ideas, or feedback, you grant us the right to use it without restriction or compensation, except where prohibited by law.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where they cannot be excluded.

We do not warrant uninterrupted or error-free operation, or that previews or AI outputs will meet your expectations.

12. Limitation of liability

To the fullest extent permitted by law, Custoo and its affiliates, officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the Service.

Where liability cannot be excluded, our total liability for claims relating to the Service is limited to the greater of (a) amounts you paid us for the Service in the 12 months before the claim or (b) USD 100.

Mandatory consumer rights in your jurisdiction are not affected where they apply to non-purchase use of the Service.

13. Indemnity

You agree to defend, indemnify, and hold harmless Custoo from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or law, except where caused by our intentional misconduct or as limited by applicable law.

14. Suspension and termination

We may suspend or terminate your access at any time for violation of these Terms, operational reasons, or legal compliance. You may stop using the Service at any time.

Sections that by nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

15. Governing law and disputes

These Terms are governed by the laws of France, without regard to conflict-of-law rules, except where mandatory consumer protections in your U.S. state apply.

16. Changes
