These Terms of Sale govern purchases made on the Custoo website. By placing an order, you agree to these terms.

1. Who we are

These Terms of Sale ("Terms") are a contract between you and Custoo, operated by MOUSSED-WERNITZ DIMOS ("we," "us," or "our"), at https://custoo.shop.

2. Scope

Custoo sells personalized, made-to-order physical products created through our online customization flow, including AI-assisted artwork, to customers in the United States.

Product availability, pricing, taxes, and shipping options are determined by your delivery address. The version of these Terms in effect at the time you place your order applies to that order. Where mandatory consumer laws provide you with rights that cannot be waived, those rights prevail.

3. Products and customization

Each item is produced on demand after you complete checkout. Your final design, product selection, size, color, and quantity are determined by the choices you make in our customization flow and confirm on the checkout page.

Preview images and mockups are illustrative. Minor variations in color, placement, cropping, texture, or finish may occur because of screen settings, production methods, and the physical product material. These variations are not defects.

You are responsible for reviewing your design, spelling, and product options before checkout. Because products are made to your specifications, change requests are generally not possible once production has started. See our Return Policy for exceptions.

4. Prices, taxes, and promotions

Prices are shown on the product and cart pages in the currency displayed at checkout, unless stated otherwise. Shipping, taxes, and duties are calculated at checkout based on your delivery address and applicable law.

We may offer promotions such as free shipping above a stated cart threshold. Promotional terms are shown at the time of the offer and may change or end without prior notice.

We may correct pricing errors before accepting an order. If an error affects a confirmed order, we will contact you and offer to proceed at the correct price or cancel for a full refund.

5. Orders and acceptance

Placing an order is an offer to buy. We accept your order when we send an order confirmation email or when production begins, whichever comes first. We may refuse or cancel an order before production starts, including for suspected fraud, prohibited content, payment issues, or operational constraints.

You must provide accurate contact and delivery information. You are responsible for customs charges, import duties, or local taxes where applicable.

6. Payment

Payments are processed securely through Shopify Payments and supported payment methods shown at checkout, which may include major cards, PayPal, Apple Pay, and other wallets depending on your region.

For made-to-order production, your payment method may be authorized at checkout and captured when your order is submitted for production or fulfillment. If capture fails, we may cancel the order and notify you.

You represent that you are authorized to use the payment method provided and that all payment information is accurate.

7. Production and fulfillment

After checkout, your order is sent for print-on-demand production through our fulfillment partners, including Gelato and its production network. Production and delivery times vary by product, destination, and carrier workload.

Estimated timelines shown on the site or in order communications are estimates only, not guaranteed delivery dates. Risk of loss passes to you upon delivery to the address you provided or to the carrier where local law allows.

If tracking is available, it will be shared by email or through your order status once the package ships.

8. Shipping

We ship to addresses within the United States.

Shipping fees, if any, are shown before you complete payment. Free-shipping promotions apply only when stated and when your cart meets the published threshold in the displayed currency.

You are responsible for providing a deliverable address. Failed delivery due to an incorrect address, refusal, or failure to collect a parcel may not entitle you to a refund of shipping or production costs.

9. Returns, refunds, and statutory rights

Because our products are customized and made to order, many change-of-mind returns are not available. Defective, damaged, or incorrect items may qualify for a remedy under our Return Policy.

Except where required by applicable state law, customized goods are generally final sale once production begins.

10. Your content and acceptable use

You may upload photos, text prompts, or other materials to personalize products. You represent that you own or have permission to use that content and that it does not infringe third-party rights or violate law.

You may not use our service to create or order products containing illegal content, hate speech, sexually exploitative material involving minors, counterfeit marks, or other prohibited content. We may remove content, cancel orders, or suspend access where reasonably necessary.

Use of our website customization tools is also governed by our Terms of Use, including rules on AI-generated assets and intellectual property.

11. Privacy

We process personal data as described in our Privacy Policy, including order details, design inputs, and checkout information handled through Shopify and our service providers.

12. Warranties and liability

Except as required by law, products are provided on an "as is" basis to the maximum extent permitted. To the fullest extent allowed by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.

Where liability cannot be excluded, our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits rights that cannot be waived under mandatory consumer protection law.

13. Disputes and governing law

These Terms are governed by the laws of France, without regard to conflict-of-law rules, except where mandatory consumer protections in your U.S. state of residence apply.

14. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Orders placed before a change remain subject to the Terms in effect at purchase, unless a change is required by law.
